Visa numbers available for EAD in US consulate in Canada?

Hello guys! I don't know if what my lawyer's saying/suggestion is true. An employer wants to hire me as a PT. My lawyer said that since my employer had advertised for 2 years now and has not been able to get a PT, she can file an I-485 and then get an EAD for me, and there are visa numbers available if we will go to US consulate in Canada. I found out that my husband's PD is not current. His case retrogressed to year 2002. I do not know if it's feasible or not. I am somewhat doubtful of his suggestion though. I am worried that we are spending too much time and money for this and that we might miss the opportunity to file for H1B visa this April. Thank you very much in advance.

Nope. The 50,000 extra Schedule A visas for EB3 ran out a while back.

There aren't visa numbers available PERIOD - it's not like there are numbers available in one location but not another. What is your so-called attorney thinking?
