My details:
I 485 RD 08/30/00
ND 09/21/00
EB 2 non RIR, India
I 140 never asked for CP, but the GREAT INS, approved for CP, and sent my I 140 file to NVC, NVC sent to Consulate, Chennai, India.

1. I wrote a detailed letter to INS stating that my I 140 file was sent back by US Consulate , Chennai India, on Jan 10th 2002. , to INS Nebraska.

2. Now INS says almost 550 days over, they are asking me to file I 824 application, (application for an duplicate approval).

3. This processess will take 6 to 8 months.

4. My attorney also wrote to INS, US Consulate Chennai, and AILA about my situation, and he is asking me to wait for the response from them. He is not advising me to file I 824 for the time being.

COULD ANY ONE IS IN THE SAME BOAT LIKE ME, IF SO, COULD U PL SHARE YOUR EXPERIENCES WITH ME. THANKS A LOT IN ADVANCE.

My I-140 approval mentioned that it was sent to NVC

Hi,
My I-140 approval says that it was approved and sent to DOS NVC and that NVC will send it to Mumbai consulate.
I never asked for CP and my I-485 application is pending since 12/20/2000, today I spoke with the IIO and he said that they are waiting for the 140 files to be connected with my I485 filing.
This is the 1st I have heard of this term.

The so called "immigration specialist" for my company says that it is common to have that message appear on the I-140 and process AOS instead of CP.

My question is: how did you learn that you file was actually sent to Chennai Consulate. I am afraid that my case may be similar. and my file my have ended up where it wasnt intended.

Any response will be highly appreciated.

I would love to speak with you about this issue if possible.
I am on PST.
Thanks.

U can send me a e mail , my e mail id is ramukesi@yahoo.com

I will be glad to share my info with U,

Thanks

This sure is INS.....

Every time you call them up they have enough tricks up their sleeves to baffle you.

God Help us all.. plz.

Ramukesi, Can you send them a copy of your approved I-140?

This is really a bummer, Ramukesi. How did you find out that the INS wants you to file the I 824 application? By letter or word of a customer service rep?

Cannot you send them a copy of your approved I-140 through your lawyer or company?

Man, these guys sure are crazy. Last resort is to cough up $1000 for a premium processing of I-140 if it can be done.

when I wrote a letter to INS stating that my file is at US Consulate in Chennai, India, and reqested

Ramukesi, Is you case special ?

By any chance, have you changed jobs after applying for 485?
Are you holding the same job/same position as the one for which the I-140 was filed?
Are you still working for the same company?
At the time of doing the FP, did you send them the Yellow Sheet for "Continuation of employment" from the same company as when you filed your I-140 & the I-485?

We know that at least two people have been approved after changing jobs on this message board. Don\'t know if they informed the INS or not, though.

Thanks in advance.

answer to NSC 6th year, I have never changed job , nor asked for CP, but INS approved my I 140 for C
