I am planning to file I-140 and I-485 concurrently soon under EB1-OR category. My wife is now working in Europe and she is holding H4 visa.
I heard that she needs to be physically present in US when we file concurrently, am I right? How long she needs to be in US? Can she leaves once we have filed say staying here for 1-2 weeks?
I also plan to file her EAD and AP also. Would that be a problem if she is not in US when these are being filed?
I am traveling out of US end of August. Do I need to apply for AP also eventhough I have a H1B?
