US Citizen marrying Indian, how to bring spouse to US?

Hi,

My friend, an US citizen marying an Indian citizen. How to bring the spouse to US?
Can he apply for K1? if K1 is granted does he need to marry again in US?
Can he apply GC for spouse in India? and how long it may take to get it?

If he is already going to be married, then a K1 is no good as this is a fiance visa. To apply for this and to get married will invalidate the K1 and the visa will be worthless.

The best route to go is the Immigrant visa route. Once they are both married they can apply for it. The non USC will wait in India during the process (they can visit the US if they have the appropriate visa mind, though they cant 'move' there). Once they have their interview at the American consulate and they have their visa in hand, as soon as they enter the US they immediately become permanent residents (the green card will later follow in the mail).

I forgot to mention, the kids in my previous post.

My friend's fiance has 2 kids (< 10 years old) from her previous marriage (divorced). He needs to bring them too to US. May we know which documents he needs to prepare for the kids?

The same i130, G325A and birth certicates only or they need any special documents?
