I have an employee who is 21 who was born in the US.

Both his parents are here illegally and have been here 20+ years.

Can anyone tell me how and if he can go about sponsoring his parents without them having to return to Mexico.

Thanks

Generally there is no way for them to get legal status in that situation without leaving the US for at least 10 years.

Some potential situations that can help:
  • Were either of them ever the beneficiary of an immigrant petition filed before 2001?
  • Does either of them have an immediate relative in the US military?
  • Does either of them have a parent who is a US citizen or permanent resident?
Otherwise, perhaps they can wait to see if the DAPA program is ever implemented. DAPA will protect them from deportation, and may also open up additional avenues to get legal status.

If they are ever put into removal proceedings, they could try to apply for Cancellation of Removal, but that's not a situation they would want to be in in the first place.
