TOUGH SITUATION

Hi there


Mmmmmmmmmmmm … frankly speaking guys


my mother will move to the US because she had a green card recently and she will petition for me toward green card .


My dilemma is :

I need 5-7 and maybe 9 years until I get an immigrant visa and moving to the US .

Which is too much for me ( big time )


I have a plan to APPLY for B-1 VISA now ( in case )

And thus I can enter to the US any time and waiting my lawful permanent resident inside the US .


Basically I am not moving tomorrow to the US .


maybe after 3-4 years .

other hand


I cant apply to the B-1 visa while my case is pending because I will get refused ..


My question is ??


how can I get a B-1 visa now ???


What I have to say in the interview ???


What is the purpose of my visit ?


I want to excuse and say …


I want to visit my brother in the US


OR

I want to help my mother in here trip to the US she is an old women & she is in 57 years old


So she need assistant


OR



I just want to go to visit ( tourism ) the US without mention my relative inside the US ??



I don’t know what is the purpose or what is my excuse to the visa ???


Also how can I improve my solid reason to return to my home country .


I just want to get a visa ( just in case ) without traveling


now ???



Any insight will be appreciated ??

21 years old , single , college student .

I am a college student I take care for my family here and I have some commitments here in my current country …… etc


HOW CAN I MOVE TO THE US AFTER 3 YEARS AND BEFORE I GET A GREEN CARD ??

You cannot bend the rules to suit yourself, so be very careful


A B 1/B2 visa is tempory visa for business or pleasure. It may be possible to extend for a further 6 months when in the USA if you have exceptional reasons


A B visa is a NON immigrant visa, you can however change status to another type of NON immigrant visa such as E or L visa

To obtain an E visa you have to invest a substaintial sum of money and purchase or set up a business.

To Obtain an L visa you must have a company trading sucessfully in your home country, but this is not an option for you

Get job offer in USA and employer can sponcer you H1B


Get student visa in USA, fee are so high though

Wait your turn like the rest of us

yes, best way might be to get hb1. but those 9 years could turn into 13. and remember, immigration will know about your petition and ask you about it. if you were to wait 3-5 years, then your choices would be better. but too much time you must wait. and you can't come illegally or go out of status if 245i doesn't come back.

you just should wait a couple of years and see how the pds are. and just be happy you aren't mexican. otherwise you might be looking at 12-17 years.

actually i was thinking just to get a visa
( IN CASE OF need to travel for a while )

because after my mother petition for me i cant apply to visa

because i will get refused

so it was just like:

plan B or backup plan if i dont have available immigrant visa

anyhow

i will wait my green card

That is a wise decision.

Also note, you will not necessarily be denied a visa if your mother files the I130 for you. You may still apply for a tourist visa and visit her. However, your burden of proof will be very high ---- you will have to prove to the consular officer that you do not plan to immigrate ON THAT PARTICULAR TRIP. Good proof would be proof of employment in your country, a current lease or mortgage, obligations in your country etc.

Also note, even if you were to apply for a visa before the I130 is filed, you may still have problems at the point of entry and you would have to supply similar documentation to that outlined above as proof. A visa does not guarantee you entry to the US.
