TN visa ..

To the gurus out there who have come across the border from canada ......

I am in the US on H4 visa , i am a canadian landed immigrant .. waiting for my citizenship to come thru in 2-3 months..... i plan to start working thru TN visa . another thing is that my husband has applied for GC and will be adding me to his petition in 5-6 months during the final stage.
I am confused a sto what should i do .. should i apply for Tn visa after i get the canadian citizenship .. is it possible to have both H4 and Tn visa together ...
please respond with ur experiences so that i can find out whats right for me...

After you get your Canadian citizenship, you can work on a TN visa if you qualify for one of the jobs in the TN category - however, TN is a non-immigrant intent visa. If you plan to change to an adjustee after a few months, you knowingly have to lie to the officer at the POE, and you would violate the terms of the visa.

However, if you qualify for a TN position, you would probably very likely qualify for a H1B visa - and since that is dual intent, you would have no issues later changing to an adjustee.

You will most certainly not be able to have two visa statuses at the same time!
