Hi guys
I just had my labor certified and am thinking of taking the CP route, which needs to be indicated on the I-140 application
while going through the forum, I saw regular CP / AC-140
can anyone tell me the difference ?
I know CP starts after I-140 gets over but
does also AC-140 also have to wait till i-140 stage is over or can it be done concurrently with I-140 ?
any pros / cons of either route ?
I-140 will be done through EB3 : will that have any effect on weather I do the regular CP or AC-140 ?

regards

AC-140 or Attorney Certified 140 is a process where the
Attorney sends all the information to the consulate directly
and requests for an appointment for his client.

This process is normally adopted by candidates who have
originally opted for AOS (485) and having changed their minds
now, want to go for Consular Process. In these cases, the attorney first files a form called I-824 for changing the process.
Then with the I-824 receipt approaches the Consulate.

In your case if you have not filed the I-140 and if your decision
is to go for CP , then make that option in the 140 petition and
file it. Once it is approved you would automatically fall in the
regular CP process.

Thank You for your reply,
Can you answer this last bit ?
Does AC-140 have to wait till the I-140 is approved OR
can I concurrently file AC-140 with I-140
(while indicating either AOS or CP on I-140)

AC-140 is possible only if 140 is approved( for AOS) AND AOS is applied.

pdd123,

AC140 is sending process of Attorney Certifying that the 140 is approved and sending it to the respective consulate, instead of your service center forwarding the approved 140 to NVC (if it accepts it).

So if your 140 is not approved the attorney cannot certify it. Also AC140 is not something that is to be filed at a USCIS office in the US or something like that. But it is to the consulate in question. So there is no "concurrent" concept here.

I heard that Chennai Consulate does not accept AC-140 cases. Do you guys know if Chennai has relaxed this a little bit?

I have not read about any positive responses to AC 140 requests.
