Depends on the RFE. Sometimes it's one or the other and sometimes it can be both.
 
RFE # 1 Recieved RFE on May 12th

RFE contents:EVL, all wage stubs from January 2004 to the present, tax returns, W2's, Ability to pay, DE-6's for all quarters of 2002, 2003 and 1st quarter 2004

RFE generated for my case on 11th may...received by lawyer yesturday..

1. Asking last 3 years w2's and copy of last three paychecks...
2. Our skin test was positive when we did our Medical...My doctor informed INS about this and told us to take medicine for 9 months...to cure this..
Now in RFE they are asking proof that we have taken care of above problem.

They did not ask any tax forms or anything like that...likely we took medicine for 9 months and we have proof from docter...

My history is:

To avoid layoff I took an unpaid leave on absence from 1/2003 to 5/2003. Join the new company in 6/2003 with same job title and 10% more salary.
2nd FP 5/2004.
RFE 5/2004

I want to use AC21 to reply the RFE and I have a couple of questions:

1. My lawyer mentioned that I have to be employed and paid by my previous employer before 180 days. Obviously I can not meet the requirement if I can not provide evidence of 2003 W2 from the previous empoyer. What is the risk of providing new empoyer's w2 only? Any other work around?

2. The lawyer also mentioned that INS will only look at the financial documents from previous employer and it doens help much if providing the documents from new employer. The reason is that the old employer is the sponsor for the LC and 140 not the new employer. Is this true?

yes, yesterday the lawyer received RFE ("1. Submit copies of your three most recent pay stubs and/or copies of your Form W-2 for the last three years also your last three tax returns. If you are not currently working for your petitioner, explain why. 2. Please provide this offices with your current physical address.").

"You are given until AUGUST 3, 2004 in which to submit the information requested. Pursuant to 8 C.F.R. 103.2(b)(11) failure to submit ALL requested evidence at one time may result in the denial of your application."

Interestingly, on May 19, online message changed to "Mailed directly" from original "RFE sent" on May 11, and I received similar e-mail notification as well.

485 RFE in Mar 04
485 RFE response received by USCIS 4/9/04

FP2 sent 4/7/04
FP2 results received by USCIS 4/17/04

Touch date for me: 5/4/04 and 5/12/04

RFE for my wife sent on 5/20/04. Don't know what this is, but my guess is immunization supplement.

Thank you ND022202. My RFE was identical with yours. Have you already replied to it? Did BCIS change your message to RFE received yet?
 
I went to the lawyer the same day they called and submitted all papers. Didn't check yet if they mailed the reply. I'm still with the petitioner by my salary is about 6% less than in labor.

I485 Application closed?

Hi Folks,

When my wife called 800# to check EAD application status they connected IIO and he said that EAD was denied and principle I485 application was closed and said sent a letter on Jun 4th and I never got any letter.

What do you mean by closed I485 application? Is that mean denied or approved?

Please help folks.
