I just got approved for LC which has priority date of oct 2002. Meanwhile, I had filed my 485 based on NIW during March 2005 (priority date of Nov 2004).
What are my options?
I was told that I could file for a new I140 and upon approval use it to subsitute the existing NIW I140 (will have the advantage of older priority date).
Can I do another concurrent filing of I140 and I485? I have EAD and AP from the pending I485 (filed using NIW I140).
Any comments/suggestion? thanks
