Please Advice (>180 days since ND, H1, No EAD and laidoff)

Hi,

Here is the situation (Hypothetical):
1) more than 180 days from ND
2) on H1 (first H1 will expire in 18 months)
3) No EAD (never applied)
4) laidoff

What are the options of a person in this situation?
1) if he finds another job
2) if he fails to find another job

Please give me your suggestions. Unfortunately there will be people in this situation, so lets all help ourselves, by clarifying what the options are.

Please check the new regulations for 180 days rule in consular processing (see other posts in this discussion groups). If those posts are correct a possible way out seems to move to consular processing while working in H1 status (since EAD is revoked once you withdraw I485).
