Let me set some context:
1. Perm applied -- April 2014
2. Perm Audit notification -- October 2014
3. Perm Denial notification -- August 2015
Denial reasons:
1. the job advertisement stated the pay rate to be "Depends on Experience"
2. Employer failed to present documentation to determine a logical nexus between the employer's referral program and the job opportunity
Internal Lawyers advice: Motion to Reconsider has been filed and the DOL's decision will be overturned, since the first reason of denial has no legal withstanding and for the 2nd one they can prove a logical nexus.
My question: is it okay to change employers at this point? i have a valid H1B till December 2016. does a denial cause any future problems? (could this for eg, create a flag on my file)
