Parent in Peru sues for support from child residing in U.S.

Parent in Peru lost U.S. residency and now sues for support...

A naturalized resident, child of a previous marriage, petitioned for one parent. After obtaining the green card, the parent entered the U.S. for approx three weeks and returned to his home and his other children residing in his home country. Parent never returned to U.S. But, after almost three years, the parent sues the child through the Peruvian Consulate for financial support. Is this legal?
