OPT expires on Aug 4, 08 and H1 Case still pending

Hi All,

I worked on H1 before ( and did not leave country for more than a year) so my employer filed my H1 to start from Aug 4, 2008. My case is still "received and pending" at Vermont service center and my OPT expires on Aug 4,08.

I am freaking out.

I have the receipt #. But I was wondering if I can continue to work after Aug 4, 08 if my H1 case still remains "received and pending" and does not get approved ???

Since you already worked on H-1 before, your application is not subjected to quota. Talk to your employer's lawyer about the grace period after OPT. Probably you are eligible for 60 days of grace period. When did your employer filed the H-1B? If filed recently, you may consider the option of premium processing (15 calender days turn around time or money back).
