My wife's OPT is ending on May 3rd 2009. Her employer is planning to file the H-1B application on April 1st.
During the time her H-1B is pending and after her OPT ends can she still be working? If not, what is the whole purpose of this Cap-Gap rule? BTW, she does not belong to the SMET category (she has an economics bachelors degree)
