I am a doctor applying for residency. I am currently in the US on a tourist visa that expires in mid Dec 2000. An I-20 has already been issued to me and sent to the INS for processing. My student visa application with the change of status I-539 form, is with the INS since the past week. I have heard INS takes 2-3 months to issue an acceptance.
In the meantime my brother\'s marriage is going to be held in India in Feb/March 2001. And the marriage date hasn\'t been fixed because of my visa uncertainity. If I don\'t hear from the INS in the next few days, is it legal to leave and then re-enter the US with an I-20 and vacation form in Feb/March 2001?
