I been silent reader for 4 years, now I need a advice
My case
India EB3 Aug 2006
I-140 approved Jan 2008
I-485 Pending since July 2007 under 245(i)
I-765 EAD since 5 of them last approved Aug 2012 for two years
I-131 AP applied in Aug 2012 approved in Sep 2012 for year
1) my lawyer said that BIA ruled out in April 2012 that if AOS in pending filed under 245(i) can get AP and travel to home country and can come back without any bar condition or abandon the AOS, Is any one hear that or travel with this kind, had any problem at the airport or POE. I want to travel to India it been 16 years.
2) I married to PR in jan 2011 filed I-130 in May 2011 VSC which is still pending since then, she become USC in July 2012 and now I filed I-485/I-131/I-765 with NBC in Dec 2012 under spouse of USC. but on the I-485 NOA have priority date as of my I-130 why is that and How long will be the process.
