N-400 applicant was denied, but did not learn of decision until 2+ years later when he got a copy of the decision after 3 FOIA requests. Still possible to file the N-336 with fee and evidence supporting a rehearing and granting the N-400 (USCIS misread the criminal file history)? Thanks for thoughts.
 
There's a 30 day time limit to file appeal. Did the applicant go for Infopasses, contact USCIS ombudsman, congressperson or otherwise was proactive about the application instead of sending in 3 FOIA reuquests to find out about the decision?
 
With the current N400 application turnarounds, it may be faster to re-apply than to figure out if an appeal can be made and make an appeal. Of course the applicant will have to spend more money.
