Mr. Rajiv & GURUS, I-751. Urgent matter, please help.

I have a family based Green Card, was issued in 99.

Type of GC - Permanent GreenCard, category: IR6, expires in 2010.

Applied I-751 Sept'01. Recently went to INS and found that I did not need to apply I-751 as they issued a permanent GC while issuing (IR6).

PLEASE tell me my options now.

1. Should I call the INS to ask them to disregard the I-751.
2. Should I wait to hear from them.
3. If so, would they call me to come to INS?

It is possible that you came under F2A ( Spouse of a Green Card holder ) and you probably waited for longet than 2 years to come to USA. In that case the Condiional GC should not have been issued. That is why the INS removed the "conditionality" without any action on your application.

Since the end result of a 751 is issuing of a permanent GC, I would take no further action on it.

When you are eligible to file for US Citizenship ( I do not know if your spouse is now a USC or not ) and wish to file for it, contact the INS again.
