Hello Rajeev Sir,
I am on H1B . My I-140 PD date is Sept 2010.I joined the company X . I have been with this company X for last 9+ years.
I filed my I485 in Oct 2020 on EB2 and receipt date is October 30 2020 with company X.
I got terminated from company X on Feb 2021 second week. I see my case USCIS online they have revoked my h1b on feb 3rd week.
We completed fingerprints/Bio on Mar 9 2021.case was updated to show Fingerprints were taken.
I got a new job with another company Y on H1 transfer receipt in Mar 25 2021 . Filed premium, got RFE on working status and education evaluation in April second week.Still have not responded .
What are my options and here are my questions.
1 What is my I-485 status (as I did not complete 180 with the sa,e employer who filed petition). Is it still valid ? Will I get EAD/AP And potentially GC.
2 Now its been more than 180 days. Can I file 485J or AC21 with my new employer or don’t do anything with my current filing until any update from USCIS or h1b transfer is complete? What’s the best advise?
3 Should I expedite to get My EAD/AP. Can I use that for new employment?
4 Why did I get RFE on the transfer? How should I respond to it.
