Linking the I-140 from the Old Employer

I have an approved I-140 from my old employer. But,
before I could apply my I-485 I had to quit that
employer and join another employer.

I have applied labor again through my new employer and
got it approved now.

Now I have to apply my I-140 with my new employer
using the labor certification I got approved recently.

The lawyer asks me to get the I-140 approval from the
old employer so that he can attach it while applying
the I-140 for the new employer.

I don't know whether my lawyer is doing for my benifit
or he is trying to set me up so that I cannot go back
to my employer if I need to!

Any insight or similar experiences is greatly appreciated!
 
Its in your own benefit !!

Once I-140 approved in your name, A PD has been established for you. SO if you attach the approved I-140 with the new application, your PD will be the PD of your old labor (not the new one).. so you will enjoy the benefit of somewhat older PD then most of the people in line for GC..

this will help you a lot in this retrogression mess
 
Thanks for the response. I am excited about the idea
that I can use my PD, in these dire situation with the
PDs.

But, if I use my I-140 of my old employer with my new
employer, can I go back to my old employer if I want
to? Or will I get stuck with my new employer?

Yes, You can still go back to old employer..
Two scenarios..

1) Your new I-140 gets approved & you file I-485, 6 months after receipt date of I-485, you go back to old employer using AC-21.

2) you go back to old employer anytime before that, & use the Old I-140 to apply for your I-485.

As long as your old employer does not withdraw I-140, its valid for you to go back & apply I-485.

Question: IF we file new labor and new I 140 from new company .. Can we still carry our previous company's I 140 priority date ?? Please suggest!

ganapathi, i have also approved I-140 and would like to find a new employer. But you gave me hope. How long did it take for your new LC to approved? Was it filed through PERM? If it is thru PERM, how long have you ben working with your new employer before you started filing your LC? Thank. I really appreciate it if you will reply to my inquiries.
