Hello. I am faced with the following scenario:
1- My 6 years of H1 was running out on September 30th, 2010.
2- With time re-capture, this date could be extended to October 28.
3- My labor cert had been approved in on April 1,2010
4- I switched employers on July 14th, 2010, and applied for a 7th year extension + transfer to new employer on that date
The extension and transfer was approved, but only until July 14, 2011. I was under the impression I would be able to utilize the full time up until October 28, 2011.
My lawyer says this was the maximum possible extension allowable, and I could not have utilized the time until October. Is this true? If not, do I have any way to capture the extra few months? (new employer willing to file another labor cert)
