This case involves a citizenship claim made as a defense to Removal. Apparently the removal case was put on hold and an N600 was filed and denied, appealed to AAO and dismissed, challenged in District Court and dismissed. THEN he was ordered removed. He filed a Petition for Review in the 2nd Circuit Court of Appeals. The case has been remanded back to the District Court for additional fact-finding (this is appropriate and allowed under the law).
