I completed my 6 years on H1 in US. However since My I-140 is approved
and the priority date is not current, I received a 3 year H1B
extension. My passport visa stamp, I797 and I-94 all have the date of
Apr 2012
My position with my company was terminated on 3/19/2010
1) Can I transfer my H1B now to another employer?
2) How much time do I have to carry out the transfer so I am not out of status?
3) Do I need to be on the payroll of any company when transferring H1B
visa? I have pay stubs only till 3/15.
4) I will receive 10 weeks severance pay as a lumpsum amount. Does this mean I am "technically" receiving salary so my H1 status is valid. Note this will be paid via check and not direct deposit.
5) What are the rules for the new company to hold my H1B visa. Can I
ask any consulting company to transfer the visa to them?
6) I have the job description which my company used for my Labor. And I
can also get the legal papers used by them for the Green Card process.
If the new employer creates a similar job description for the new
position which I join; is it beneficial to my green card status? Does
the new employer need to do the labor and I-140 again? Can I retain my
priority date of Dec 07?
