I was laid off in July 2012 and has to travel back to India as i was out of status. My H1 visa stamp is valid till end of November 2012 and I have copy of approved I-140 as well. I got a job now in US, so can H1 be transferred to new employer with me being in India? The current employer is asking me to travel to US on existing visa and then they will file my H1 transfer as they need a valid I-94 for the transfer.
Also, since i don't have salary slips from July 15th onwards, would that pose any risk in transfer getting denied? I travelled out of US on August 5th.
Please suggest me what should I do in this case?
