Hi All,


I need some urgent guidance on my H-1B situation:


  • My old employer terminated me and my last working day was 29 Aug.
  • Another employer filed my transfer in premium, I got the receipt number, but the client closed the position and employer may withdraw.
  • A big bank employer is ready to file, but their LCA is not yet filed (DOL delays).
  • As per my understanding, my 60-day grace period started from 30 Aug, so I’m good until around 28 Oct 2025.

Questions:


  1. Can the new employer still file H-1B with LCA once DOL reopens within my grace period?
  2. Do I need to inform the client about my termination, or is it only between me and the employer?
  3. Should I file a backup B-2 application to maintain status in case the LCA delays continue?
  4. Any risks since I didn’t inform the client, but employer withdrawal is likely?

I want to stay compliant and not risk my status. Any advice or similar experiences would be really helpful.

Now my visa is approved and company run first payroll but they lost client and asking the pay back and telling me u not onboarded fully , the other company did not have lca yet due to shutdown
