I am on an L1A visa and my spouse on an L2 (EAD and currently working only recently), my spouse recently moved out I have the following questions.
Can my spouse's employer sponsor for his greencard independently of my L1 status or will he need to move to H1B first?
If yes, must this be submitted prior to me filing for divorce?
I know that the L2 becomes invalid on the divorce finalisation but if a GC application has been submitted will that negate that rule?
Can he remain in the US out of status with a pending GC application?
I know I should ask an immigration lawyer but to be frank I just don't have the money to do this.
