K3 Approved and Forward to US Embassy - Please post experience

Just wanted to let you know my K3 was approved on Nov. 25, 2002 by MSC. It was reviewed on December 11, 2002 by National Visa Center. I received a letter (on Dec. 16, 2002) dated Dec. 11, 2002 (so i am assuming my case was reviewed on 11th of Dec. or before) by National Visa Center that NVC forwarded the case to New Delhi Embassy.

I will now ask my wife to contact Delhi embassy to find out when her interview is.

I wanted to post my experience here. If anyone has their experience, please post here.

k-3 approved

Our K-3 was approved on 12/13/02, received notice from NVC on 12/24/02. As of today, 1/13/03, we are still waiting to hear from US Embassy in Nicosia, Cyprus.

I'am asking a little too much. I'd be taking my Oath for us citizenship hopefully pretty soon. So please elaborate the procedure in detail about the I-130, I-129f and eventually the k3 visa for my wife. I understand the once we receive the receipt of I-130 we can apply for I-129f and from there k3 visa . Please correct me if I'am not right

Please post your time line starting from the I-130 application including all the details. My situation is exactly similar to yours except my consulate would be Chennai in India.

NVC

NVC = National Visa Center. Once your I129f is approved, it is sent to the NVC, and the NVC assigns a case number and sends it to the embassy. You are correct, after you receive the 1st NOA for I130, you can then file the I129f, send a copy of the NOA with the petition.

Please bear with me a little longer. When does the affidavit of support come into the picture and if so a $10,000 bank balance would be enough?

And finally what is this second approval of I-129f?

Since I have not been through the process yet, I can't say specifically what will be enough. I know that they look at your salary and assets. You will need to show evidence of support when your spouse goes to the embassy.
My approval for the I129f was the 2nd NOA @ 12/13/02

As far as the documents .... a normal copy of 'The certificate of citizenship' ,Marriage copy and other documents would be sufficient? Or do we need to make a notarized copies of them all?

You will need originals of everything. YOu would be better off emailing the embassy and asking the specifics.
 
Hi... Here's my experience....
Oct. 27-- send I130 to Vermont
Oct. 31-- 1st NOA (i130)
Nov. 7-- send I129-F to Chicago
Nov. 15-- 1st NOA (I129-F)

Im still waiting for the approval.... I really can;t wait. It says in the reciept that we got, it will take 60-180 days but when i check the internet for the online status, it will only take 60 and 90 days. Now, i dont know which one is accurate. I hope the online thing. I really can't wait to be with my husband. Good thind he lives in PA and I live in Toronto.. he always visit me every weekend. Still, I want to be with him everyday....

Hello Durgam:

Below are my timelines for K3 visa for my spouse:

1) Applied for I-130 in May, 2002 (Sent in my Application on May 20, 2002). They received it on May 21, 2002 and I received Notice of Action that my application has been received. My Receipt date was May 23, 2002
2) Applied for my Spouse for K3 on August 12, 2002. Receipt date was August 13, 2002
3) Got I-130 approved on October 7, 2002 and received Notice of Approval on October 10, 2002.
4) Got Letter from NVC on Nov. 11, 2002 that they are ready to process overseas consular processing. They asked me to send $65.00 to them for Affidavit of Support Fee so that they can send the AOS form. I had to send the fee to St. Louis first and then Saint Louis will notify New Hampshire of the fee and New Hamshipire will send me AOS form (I-864) form. Also at the same time i.e. in the same packet received on Nov. 11th, 2002, I received Choice of Agent letter for my wife to designate someone for her to have correspondence from NVC. I already had downloaded the Choice of Agent form and asked my wife to sign it and send it in. This was before Nov. 11, 2002. I got her Choice of Agent form signed end of October. The only thing with the downloaded copy is that it doesn't have barcode written on it. When NVC sends you the Choice of Agent form, it has barcode on it. So on Nov. 11, 2002 when I got the Choice of Agent letter along with the AOS support fee letter, I sent both of them i.e. Attached my wife's signed Choice of Agent form (without the barcode) with the one which was not signed. With the barcode, it is easy for them to just scan it and put the documents into their system. Choice Of Agent letter goes to New Hampshire directly.
5) My K3 visa petition got approved on Nov. 25, 2002 by Missouri Center.
5) My Money order for I-130 for $65.00 got cashed on Nov. 24, 2002. I got the AOS (I-864) form on Dec. 7, 2002.
6) Now I received the Fee Bill for Immigrant Visa Application i.e. $335.00 on Dec. 6, 2002. I sent the $335.00 on Dec. 7, 2002 and Saint Louis received it on 9th December.
7) I sent my AOS (I-864) form signed and notarized on Dec. 10, 2002 and New Hampshire NVC receives on Dec. 11th, 2002.
8) I receive a letter from NVC on Dec. 11th, 2002 that they have sent my wife's K3 application to Delhi on that day via email.
9) My Cashier's check gets cashed on Dec. 24, 2002 for $335.00.
10) My wife emails to New Delhi Embassy on Dec. 26, 2002 asking about the K3 petition and interview date. New Delhi Embassy responds back on Dec. 31, 2002 telling her that her interview is on January 27, 2002 at 8 AM. The case # which Delhi Embassy responded back was different as compared to the NVC K3 case #. Delhi Embassy creates a new case # when the K3 visa case arrives in Delhi through email.
11) My wife receives a letter from Delhi Embassy dated Dec. 31, 2002 about K3 processing (Appointment Letter) on January 4th, 2003.
12) I receive my Immigrant Visa application for wife on January 6th, 2002. I sent in my Immigrant Visa application to NVC on January 10, 2002.
13) NVC receives DS-230 application (Immigrant Visa application) Part 1 on January 13, 2003.
14) I send all of my Non-Immigrant papers i.e. I-134 Affidavit of support form, my employment letter, my assets values, my tax returs etc. to my wife on January 10, 2002
15) My wife does her medical on January 16, 2003.
16) She interviews for K3 visa on January 27, 2003 and they give her visa the same day although the visa is picked up by her the next day as Embassy forgot to ask her for the passport in the morning when she interviewed and asked her to come at 4 PM to pick up visa on 27th. When she went, they told her she would have to come tomorrow (28th) to pick it up as they didn't have her passport. At 4 PM, my wife gave the passport and then came on 28th at 4 PM to pick up the passport with visa and all her documents.

There is no notarization required for marriage certificate, Employment letter etc. You only require notarization of I-134 and I-864 form. But what I also did was I declared on a seperate sheet of paper what were my assets. I had three seperate letter telling my Real Estate value, stock value, personal property value and I signed that and got that notarized as well. I also attached my proof of value but didn't get those notarized.

That was a long and clear timeline with a lot of details big and small.

But please bear with me a little longer as is my citizenship Oath ceremony is taking a long time . As of today it is been amore than 11 months wait since I passed the citizenship exam in New Orleans Louisiana(02/28/2002) and still my oath ceremony has not taken place. During my last visit to INS New Orleans on 01/14/2003 they told me My oath ceremony would take place in a month or two. Let us hope it gets done by march/2003.

Now as far k3 visa is concerned may I know why was I-129f NOT mentioned at all in your timeline ?What I understand is once you get your I-130 receipt you need to apply I-129f and then a k3 visa.


From the time of your receipt of I-130 on may 31 why was a time lag till august 12 to apply for your k3 visa(I'am assuming that it is I129f application)?I would have done the very next day as there has already been a long delay for my oath ceremony.

I have a feeling that in your case I-130 was sufficient for your wife and there was never a need for the I-129f at all.

Please clarify when you get a chance.

Hello:

First of all, I don't understand why your oath has not taken place. My oath after Citizenship interview was within a month. They gave me a letter the same day of the interview telling me when my Oath was.

Regarding the K3 and I-129F, you have to file I-129F (Fiance visa application) but it is actually for K3. If you open the I-129F application, it will tell you what to do for K3. The application is I-129F for K3.

The reason I filed the K3 so late after I got the I-130 receipt was that I found out that K3 was taking the same amount of time as I-130 so I didn't file the I-129F for K3.

But I eventually did. My wife will be here next week.

That makes a lot of sense. New Orleans Louisiana INS is taking a long time for the us citizenship. I know a lot of friends in Houston TX who got their oath in 11 months from the date of applying for n400.Thanks any for the clarification , I'll keep my sage posted as they develop.

Please tell me. About I-130 with NVC. I just mailed my I-864, affidavit of support form back to NVC. Now, what I need to know is that, is NVC going to mail packet 3 to me now or are they going to mail the request for $335 fee. Please shed ligth from this point onward.
