I am EB3 India with a PD of August 2001. I am one of those ppl screwed by DOL where my labor was approved after a wait of nearly 4 years. I can not file for I 485 due to retrogression.
I am alo a Canadian PR and need to move to Canada latest by Jan 2008 or else I will loose my PR.
I have worked for same firm for nearly 7 yrs since I graduated with my MBA. My firm will most likely transfer me to Canada office and give me a job there.
If I move to Canada I think it makes sense to stay there for 3 yrs to get Canadian Citizenship. Lets says while I am in Canada PD becomes current. Is there a time limit within which my company must file I 485 ? My I 140 has been aproved so I am not subject to the proposed 45 day LC expiry.
So I guess my question is if suppose my PD becomes current in 2009, can I come back to US in say 2012 and file I 485 and get GC. Company has guaranteed not to revoike I 140 but will only file I 485 if Im on US payroll.
