Gurus,
As u know, if u enter on AP, they put the "valid until" date on your I94 same as expiry of your AP.
I know we can still stay here legally even after that date on I-94 expires as long as we extend our AP for another year before the old one expired.

My Q is:
While departing US after 1 year, I'll give my I-94 back. The officer might see that I "overstayed" beyond the valid date on I-94. So while coming back to US, Can i face some problem?? I can argue that there was nothing illegal but what if that officer is not aware of the law fully (always possible). Has anyone experienced any problems??

Please Confirm

Have you or anybody have done it??? PLEASE confirm. This is the first time I'm hearing something like it. I was not sure if we can approach immigration dept at the airport w/o actually entering the country.

I just entered on Sunday and was also concerned about this issue. I found a link on murthy with a comment regarding this. They say, ignore this date, it's not a problem as long as your I-485 is pending.

The date stamped on the I-94 when you enter using AP is irrelevant.

I have done that and stayed beyond my I-94 date (entered on AP) and re-entered again -- no issues at all.

THANKS guys!
My only worry is sometimes the immigration officer is ignorant of these technical details & can give me hard time. Should I carry some printouts just in case? Do you know from where I can print it?
