I140 - Has anyone gotten an RFE due to Education criteria

We are in process of applying for the I140/485 -

My lawyer just went for a law meeting where the topic of discussion was Education on EB2.

I have a Masters from the US and that is what the basis of the application is. Masters + 2 yrs and i have both. I have an undergrad from Inida which is only 3 years. I did a one year diploma course which is what covered my 16 years to get into the US programme.

Now the lawyer feels that they might be a RFE since a lot of cases are getting rejected due to this? He is saying that they are saying that undergrad was not 4 years? Anyone face or hear of similar situation like this. I would appriciate a promt reply - i am running out of time.

What I personally think...

I think as long as you have an MA from a US acdemic institutiuon, the question of you undergraduate degree becomes invalid. The logic is that since that US university had admitted you into its grad program, then they musdt have done all academic evaluation and found that you eligible. These are my personal thoughts so I wont worry. I hope you get a more affirmative answer. Good luck budd.

your MA from a US university is acceptable and it does not need a translation. i would contact my school and ask them for a copy of the evaluation they have on file and send it along with the US school transcript.
