Hi,
My husbands I-94 is going to expire in few months. Actually, I came on H4 initially & so i too have same expiry date as my husband in the I-94 (POE). Later, i converted to H1, got approaval & working for more than a year. Till now, i didnot get my H1 stamped. Now, my question is - My husband can extend his visa & so he will get his new I-94. What abt me? As i got my own H1, it means that i already have new I-94 (which i got along with my H1)? This time, when i go to india & come back, do i need to handover both the I-94 forms to POE? Reg. H1-B extension of my hubby...please give me the detailed procedure & when should he apply for extension?

Hand over the latest I94 to airlines while going out.

Your H4 I94 was superceded by H1 I94. While coming back you should have a H1 stamp in the passport. Plan to get the H1 stamp in the passport.
Your husband can get his extension done at department of state by applying 60 days before expiry of the existing H1. click on revalidation in http://travel.state.gov/visa_services.html

You cannot get H1 stamp from DOS.

similar situation but different question.

I am in a similar situation. But my question is a little bit different.
Do I have to handover the latest I-94 which is at the bottom of the I-797 before leaving US. If yes, then when I go to india to get new H1 visa stamp, does the consulate require the whole form I797 with I-94( bottom portion)? or just the upper portion is fine.

Thanks much
