I-485 Question

I was an H1-B worker and was laid off about 2 months ago. I will be marrying a US citizen soon and would like to adjust to a permanent residency status. While filling out form I-485, there is a question that asked what my current status is...

Should I put H1-B in there although I have been out of status for two months? My H1-B Visa and I-94 on my passport does not expire until the end of 2003.

Any information is much appreciated.

It seems that you are either in H-1 status, or you are here illegally. Just because you have not been properly maintaining your status oes not give you another status.
