Hi Bamana,

Recently our cases (both mine and my wife) have been transferred to Local INS in LA California. I wanted to know the reason, why my case has been transferred. For that, Can I go to the Local INS in LA and ask them the time frame and any supporting documents are needed??

Did you received any notices from the local INS, when the case is with them. If so, when did you receive it.

Please share your experience with us would be greatly appreciated.

My Case details

I-485 Applied on 25/10/2001
Category = EB2
Service Center = NSC
No job changed an no address changed
Case Transferred to Local LA= 01/13/2003

Hi Kiran,

There is no point in going to local INS for asking any thing, they wont tell you any thing. You or your lawyer must receive a notice from INS on form I-797 that your case has been transferred to local INS office for conducting interview and scheduling of interview may take months... blah blah....
Local INS will not send any letter to you or your lawyer saying that we have your case.
when LA local INS will schedule an interview for you then they will send you a letter saying that what docs you need to bring, what date , what time etc..

Till than sit back and relax. Getting an interview call from LA office may take between 2-6 months, no fix time.

Congrats Bamana !!
Did it take 8 months to schedule the interview ? What were the documents they asked you to bring in the interview ?
My case was recently transfered to SFO INS. Seeing your case, I am not very hopeful of a interview before Aug-Sep.

SF Interview Complete - Waiting Approval (or not)

I am in a similar situation...

Category = EB3
Service Center = CSC
I-485 Receipt Notice = 07/16/01
Fingerprinted = Last week of Nov 2001
Case Transferred to Local SF = 03/21/02
Visa on passport expired = 06/22/02
Obtained EAD (although H1 still valid till 06/2003)
Interview notice = 11/18/02
Interviewed on = 12/18/02

Obtained EAD/AP and travelled abroad on 01/10/02
Returned on 01/27/02
Had to go through the secondary INS room
at customs due to entrance on AP instead of H1
The INS officer didn't let me enter on H1 because the
visa stamp had expired (although the H1 notice was
valid till 06/2003) ... so I'm here on AP/EAD status

Received a mail request from the INS/attorney that
I should mail my AP and I94 to them for the 485 to continue.
Received acknowledgement on 01/29/02 that the 485 process
has indeed been resumed due to timely return to country on AP.

Am now awaiting the approval notice.
My timeline seems to be almost the same as Bamana
but I haven't received the approval notice yet (perhaps
due to a delay due to international travel). Will post a
message as soon as this happens.

Has anybody else been approved for their 485
subsequent to an interview after 12/2002 and after
this new FBI clearance + DHS stuff began?

acidnuke,
what was the reason for your interview ? INS must have asked for specidifc documents for you to bring for the interview. What were those documents ?
According to my lawyer, interviews are being called for all the people who have changed jobs and thus the present company is different from the sponsoring company.

I was surprised to have been called for an interview.

My employer hasn't changed since the start of my application.
The only difference is that I got married 2 weeks before my TRANSFER NOTICE came through. And the interview was really just a formality ... wherein the INS officer was reviewing my documents and asked random questions such as ...

1. When did you last enter the country?

2. When did you first enter the country?

3. Who is your employer?

4. What is your current salary?

... etc

I was told to bring tax returns for the past 3 yrs, an employment letter from the company, last 2 salary paystubs, etc. Nothing special really. And my name doesn't begin with a Mohammed either. So it seems like a completely random incident.

Congratulations

PD 98 ..got approved now.

Good luck gentleman..Thanks for your detailed information.

Thanks to this forum for all its feedback!

acid,
First I would like to congrates you, now I have a question.
When you went for interview at that time officer who took your interview why he did not ask for your AP and I-94 , or he did ?
Why did you required to send them after interview ?
I am asking these question since my wife is having interview at SFO on 13th so pl reply ASAP.

The officer DID ask for my I-94 at my 12/18/02 interview.
The I-94 is not returned. In addition, the INS officer will
ask several questions regarding the marriage, confirming
documents that were previously submitted and any specific
documents that they REQUEST for in the interview letter.

In addition, after returning to the US on 01/27/03 (travelled
abroad on an AP), I was told to submit my AP and my newly
given I-94 by an RFE request (that my attorney recd from the
INS). This was to ensure that I had returned to the US before
the expiration of my Advance Parole document (I think).
