Hello Guru's,
I am newbe in this forum.

Question Background:
H1B (NH Jan 7th, 2004)
soon tobe married (9-12 months from now)
Got Labor aproved Mar 15,2005 (New Hampshire, EB3).
Desi but friendly employer.
Employer says 140 will be aproved in 4-6 weeks after I apply.

Questions:
Can I wait to file for 485 UNTILL(Approx 7-10 months) I get married.
is it in my control?

What will be the process or events happens after I-140.

The aproval rate for 485 is very bumpy as I heared from my employer
he said it might get aproved in 6 months to 18 months.

Considering Best case; I would be in trouble if I am not married and got 485 aproved.

Can someone share their experiences or what they did/doing in such situation.

Guru's opinion is much appreciated.

Thanks,

Hi,
I know one person who was in a similar situation to yours in 2004. He did concurrent filing of I-140 and I-485 based on his lawyer's assurance that it will take at least an year, so he will have time to get married. Unfortunately, his I-485 was approved in record time - something like 2 months, much to the annoyance of a lot of other people at his office who had applied much earlier. So, I wouldn't bet on the timeline for the I-485 if I were you.

I think you should be ok filing the I-485 after you get married, but it is better to check this with the lawyer.

I-140 timeline can also get extended with RFEs especially if your employer is a small company.

Best of luck,

Em

Applying I-485 depends upon the priority date. If your Priority date is not current then you cannot apply for I-485. As of now cutoff date is Jun-01-2002. If you have labor which was applied before that then only you can apply for I-485.
