I-140 and EAD

Hi guys,

My LC is approved. Can I file I-140 and EAD concurrently instead of I-485? Because my H1 expires in 45 days not only that I have to get my birth certificate and other documents from India, probably it would take atleast 3 weeks from now to get these documents.

to my knowledge, you can file I-765(EAD) along with your I-485 or with the receipt of your I-485.

Hi. Thanks for the message. Since the new Immigration rule allows us to apply for I-140 and I-485 concurrently. Why can't I apply for I-140 and I-765(EAD) concurrently. I can't apply for I-485 now since I don't have my birth certificate with me and my H1 expires soon.

If ur Birth Certidficate is taking long to arrive...U can still apply 485..You will get an RFE for that..Ins will not stop u from applying...please cross chek on that....
