I-140 amendment questions

I-140 amendment questions, jaxen please reply.

I have filed for my 485 in May 2002 and my company is going through a merger.

1. After the merger should I amend my i-140?
2. If I file for amendment, is there a new 180 day clock start from the date of approval of I-140 amendment?
3. If I don't file for amendment and I get laid off after the merger how do I prove to INS that I have completed 180 days with the company applied for my I-140?

If th emerger is happening after 180 days,AC21 is your saviour. If not your losses will be better covered by filing for an amendment. Yes, the clock will be reset. However nobody knows when the 180 days counting starts for a concurrent filing.
Best is I485 rd+180 days with I140 approved
Worst is Wait for I140 approval and wait 180 days..

In my case, as you would have seen in the other thread, I-140 amendment approval came after 330 days of filing I-485 and after 290 days of providing finger-prints. My I-140 amendment, due to merger, was approved on June 26,2003. Do you think that I have forfeited the 180 days concession of AC-21 already and my clock is reset from June 26, 2003?
