If passed into law does this have any positive implication for the h1 visa holders who are not gone thru Labour clearance route
for GC/Adjustment of status or is it meant only for illegal workers

If anybody can understand /read between lines ,comments appreciated

Let this sink in some more time. Seems like good news. 5yr residential requirement, legal presence, spouse and children get automatic GC- unbelievable. Is some of the congress persons aiming for immigrant votes?
I am using a lens to read the fine print and what is missing...

Unless Im missing something.. this does nothing for people in lawful non-immigrant status. It only seems to imply legitimizing people who were here illegally..

To meet this bills requirements
In Section 2(A) : the alien must have been in unlawful status
2(B): any non-immigrant status must have expired
2(C): not subject to 2 year residency requiremnet (J-1 Im thinking)
2(D) in a lawful status, BUT OTHER THAN NON-IMMIGRANT status (wonder how can you in lawful but non-immigrant.. maybe some pending asylum status)

Maybe Congress wants all legal immigrants to overstay their visas, become illegal and then apply for this quick green card

sec5A of hr 3271 states as follows

A) IN GENERAL- The alien must have been employed (whether or not lawfully) in the United States, in the aggregate, for at least 520 of the workdays occurring during the 5-year period ending on the date of the enactment of this Act.

this seems to suggest that that includes lawfully employed (like H1)

Folks , what about this news. Does this has something to do with this new immigration policy thing.
Just curious bcaz probably its the first time our President has publically talked about Immigration in his speech.

President Bush (news - web sites) wants to give legal status to foreign workers who obtain jobs in the United States as well as the millions of illegal immigrants already working in the country. . The proposed change in U.S. immigration policy could smooth relations with Mexico and help lure Latino voters. In a speech at the White House Wednesday, Bush will outline ``principles'' to guide new immigration legislation, including providing foreign workers with incentives to return home, a senior administration official said. But workers accepted into the program would be allowed to immediately, with an employer's sponsorship, begin applying for a green card, which allows permanent U.S. residency. Although these workers would get no advantage over other applicants already in the long line for green cards, an illegal immigrant who attempted to apply now would simply be deported.

there you go more green card applicants. More LCs
