My question is simple. How 485 is processed at USCIS? Is processing based on Priority Date or Receipt date? Do categories like EB2-3, sub categories like RIR-NONRIR would matter for 485 processing?
Scenario Example:
Person A and Person B become current with July 2007 bulletin and decide to file 485. Their xcase history is asunder.
Person A:
---------
Labor PD: 08/2003 (Backlogged at BEC)
Category: EB3-RIR (Earlier NON RIR and then converted to RIR)
I-140 approval: 06/2007
485 receipt date from USCIS: 07/20/2007
Person B:
---------
PERM Labor PD: 06/2006
Category: EB2
I-140 approval: 10/2006
485 receipt date from USCIS: 07/02/2007
Assuming Clean applications and "No Name check delays" and "No RFEs" who will get his 485 approved first?
