hello all:

post green card marrying someone in india is an issue so i am doing it with someone with F-1...

anyhow would someone please tell:

1. Can i file for her residency based on my card right away after marriage..
2. How long she will have to maintain her own status..i would assume once you file i-485 for her, then she will in pending adjudication status and prior status will be abandoned just like it happened in case of H-1 etc...
3. How long after filing I-485 (2yrs??)

I don't think u'r future spouse will be eligible for 485
since u already have a green card.

He will have to maintain her status by herself (H1, F1 etc) till 5-6 yrs.

Sign the petition for V-visa to allow spouse of GC holder to
stay in US.
