help me: 2 questions

hi guys
realy need this information.
i finished with a masters in summer 2005 and did not take my opt but instead joined a phd program at a different school.I now regret that and want to leave the phd program for a job.my new school wont let me graduate with a masters so i plan to quit phd in between.this means i CANNOT get an OPT.As i understand i can have a company file for my h1b in april for the2 008 quota ( i would be on f1 status then) but cant start working for them till october1st. my questions are

1. does my f1 status get cancelled immediately on filing for a H1B and i go out of legal status even though my h1b has not been approved or does my f1 status get cancelled upon approval of h1b petition.F1 status getting cancelled immediately upon filing for H1B to me seems unlikely as then for someone who is is on OPT and files for h1B, a negative h1b decision would also result incancellation of OPT or F1.

2. if my f1 status does get cancelled immediately upon filing for h1b, can i stay in the country (without working till october or studying) based on the fact that my h1b application is in process, if so that solves my problem of not going out of status.

3. how long does it take to get a h1b approval decision after filing it in april

would really appreciate any inputs you can give me.fell free to comment and advise.
 
I do believe that you have to be in F-1 status till October 1.

There was a ruling about the gap a year or so ago for F-1 students whose F-1 status ended in the summer but who cannot start working until October, but I don't know if it still applies - especially to you, since you will be ending F-1 status voluntarily before the program ends.

so does it mean i go out of f1 status the moment i file for h1b or i do i lose my f1 status once my h1 is approved
