H4 visa stamping question

My brother-in-law is getting married in India in February 2007. He has recently changed his job and had applied for h1 transfer. He got an RFE to which his employer replied in December 2006. He has still not received a decision from USCIS on his case. When he gets married in India and his wife has to go for h4 visa stamping at the consulate in Mumbai, will a receipt notice work which says that he has applied for transfer and case is still pending or I-797 IS REQUIRED for h4 stamping? He has h1-b visa stamped in his passport based on previous employer's sponsorship. He can also produce new employer's current employment letter and recent paystubs. Can anyone help us with this? Thanks in advance.
 
A receipt is not an approval. She needs the approval to get a new visa. She, however, does not have to get a new visa. She can enter with the current valid visa as long as her H4 approval has not expired and her husband keeps his H-1B status.
