I am currently on F1- STEM -OPT(authorization till December 2023). Husband’s H1B is maxing out in April 2022 and his PERM will be applied this month-end. kids are on H4. Their H1B/H4 expired on 12/31/2021 so applied for an extension till April 2022. We are yet to get approval but received the receipt numbers. I am planning to move them as dependants under me. Initially, we were planning to get F2 stamped in India but getting an In-Person visa appointment is taking a long time so we want to initiate F2 COS.
1) To become eligible for F2 COS, current nonimmigrant status should be valid. since our H4 extension is in progress, Do we qualify for COS?
2) If so, can they stay legally in the US on the F2 receipt? Are 3 months sufficient to get an F2 receipt notice?
Kindly help us with the above questions.
