H2B Visas don't overlap, must leave country to start new one. HELP!

Hi guys,

I have a curious situation that many people I am sure have found themselves in. I'll try make this brief, whilst giving lots of details.


I am a British male working at a ski resort in Utah.
I have had an H2B over the 2008/09 winter season then went home.
I then returned to the US and have legally extended since winter 2009/10.

This year, my current extension runs out 15th November, but my winter visa will not start until 1st of December.

What are my options here? How long do I need to leave the country?

I am going home to for my brother's wedding in September for 2 weeks and planning to return on my current extension. Do people think I should just stay home until December? Or should I travel to Canada to get my new visa?

I am concerned that if I only go up there for a few days/couple of weeks they will deny me. But at the same time, I don't really want to go back for 2 months. But from the visa rumour mill, it sounds like staying at home might be the safest option of getting a new visa.

Any advice? I am in a bit of a pickle! I do have plenty of evidence to return to the UK (I own a house there, strong family ties, I could have a job offer letter...)

My HR department doesn't have all the answers so I am hoping someone can help me.
