I am planning to go to Canada to have my H1B stamped/renewed along with my AP (just in case). If I get stuck for security clearance I plan to get back using my AP; If all goes well I would like to come back using my renewed H1B Visa (stamped)
My questions are:
1. If I get stuck for security clearance would it be a problem using AP (keep in mind they will mark my previous visa as “Cancelled Without Prejudice).
2. After I already use my AP once and then if get the security clearance from US Consulate in Canada, can I go back to Canada (from USA) to have my Visa renewed and come back as H1b instead of using AP.
A little more details:
Recently, I scheduled an appointment in US Consulate in Canada and within a week I received a phone call suggesting I should go there prepared to stay longer than usual for the purpose of security clearance.
Reason for H1B: I plan to have my spouse come here on H4 and then add her in my ongoing I-485.
