H1b renewal from country of origin?

K.A.Q

Hello,

My company has applied for my H1b extension. Is it correct that to get Visa, I MUST have to go to my country of origin, get stampted (if approved by US consulate) and come back?

Also, I have heard that it is upon INS to decide that an employee must go immediately (to be eligible to work) for stamping or go at time of conveience. Is there any other way to get visa stamped while staying in US.

I have not left US after coming on H1b. Will this be an advantage for my processing.

TIA

H-1B renewal from country of origin

If you applied for an extension before the expiration of your status, BCIS will issue you with an approval notice with the I-94 attached. In this case you do not have to leave the country and get a visa stamped in your passport. Please keep in mind that the visa in your passport is a travel document only. The document that makes it eligible for you to work and stay in the US is the I-94.
