H1B Laid off - New Job offer - Ready to file premium processing H1B

I was laid off 40 days back. Very next day I had telephonic interview and after one week I had a new job offer. My first employer was also US MNC through which I have my present H1B visa stamp valid till 6th September 2012. I changed Job in 2010 but continue to travel in and out of US with first employer's Visa and different I-94's everytime. Previous and new employers are US company MNCs. My H1B Visa is valid till 6th September 2012. I-94 valid till August 2013. I have following option as per attorney:
1. Just apply for I-797 without asking for I-94. Go out of US to Canada or Mexico and come back with new I-94.
2. Apply for I-797 asking for I-94. If approved OK, otherwise may have to go to India for consular office for new Visa stamping.

I reside in California, so if going to Canada or Mexico, which one is better? Where exactly (which city) in Canada or mexico I should go and come back.
