H1B cap may reach much earlier

I'm now starting this project for those who are counting on H1B visa: when the H1b cap (65,000 for FY2004) is doing to be reached.

As you all know that the temporary raise of H1b cap based on Congress DOS DV2001 expired after 9/30/2003, which means the H1B cap is back to 65,000 level for FY2004(10/1/2003~9/30/2004) from 195,000 level for FY2003. This reduction may raise an serious issue for those who solely relies on H1B for legal presence and chances are this cap may be reached much earlier than anticipated.
You may have to face the situation which happened during FY98, FY99 and FY2000 where you are lucky to find a job but you cannot secure it due to H1B cap. So be prepared for the worst case and takes action in advance.

It can be concluded that two-month's approved cases have already used half of the FY2004 cap. We're waiting for the data of Dec, 2003.

Hi H1Bcap,

I am currently in the process of getting employment from a US employer and hence this information is very valuable to me.

In your post, you mentioned that the H1b cap of 65000 for 2004 is valid from 10/1/2003 ~ 9/30/2004. Are you sure that BCIS goes by Financial Year and not Calendar year i.e (1/1/2004 ~ 12/31/2004). Can u please inform me as to where you confirmed these dates from.

As I mentioned, since I am working on new employment offer this is vital to me and I'm getting a little worried about it.

The BCIS fiscal year is 10/01 to 09/30, as H1Bcap mentioned.

Here's an extract from an old (then) INS publication:

"The Immigration and Naturalization Service (INS) reported that during the first quarter of the current fiscal year, from October 1, 2001, to December 31, 2001, approximately 28,000 H-1B petitions had been approved against the 195,000 limit for FY 2002."

It's a know fact. You can confirm with the lawyer who will process your H1-B regarding the same.
