H1 to H4 change of status

I was terminated from my Job in Jan 2011. I am looking forward to change my status to H4 visa but I know I was out of status for a month now. What are my best options in this scenario?

Then you can file I-539. Include evidence of your current status (copy of your current I-94), your spouse's H1 status (H1 approval notice).
Is your I-94 still valid?
