Can I continue working after H-1B expire and extension application pending

Hi, Guys:
My H1-B will be expired by the end of Sep. 2002. My employer has sent out the I-129 extension application for me. I don't think it will get approval before Sep. 30. I am wondering if I can work before extension approval.
Your information will be greatly appreciated.

I-94 or I-129?

Hi Midwest,

I would worry about the I-94 in your situation, instead of I-129. If you could not get I-129 approved before your I-94 expires, which status you would use to stay in the states? That may be a concern, because your I-94 determines how long you could stay.

You may want to check with your attoney on this issue.
